Agreement to Terms

By accessing or using THRY.ARCHIVE (“the Service”), including any tools, the shop, the blog, the Academy, and any other features provided through thryarchive.com, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the Service.

Description of Service

THRY.ARCHIVE is an independent record label that also provides a platform of tools, services, and resources for musicians, producers, and labels. The platform includes but is not limited to:

• Smart Links - customizable link pages for music promotion
• Artist HQ - career management dashboard
• Label Dashboard - label operations management
• THRY.VISUAL - video generation and YouTube upload tool
• Distributor Comparison - music distributor research tool
• EPK Builder - electronic press kit creation
• QR Code Generator - custom QR code creation
• Press Release Generator - press release drafting tool
• Academy - educational courses and resources
• Shop - merchandise store
• Blog - news and editorial content

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We may add, remove, or change features, tools, or pricing without prior notice.

Accounts

Certain features require you to create an account. When you create an account, you agree to:

• Provide accurate and complete information
• Maintain the confidentiality of your login credentials
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these terms, provide false information, or engage in abusive behavior. Account credentials are generated by our system and emailed to you upon registration. You should change your password after your first login.

Free & Paid Tools

Some tools and bundles are provided free of charge. Others require a paid subscription. Pricing, features, and availability are subject to change.

Free tools and bundles may be used without payment. Free tiers may have feature or capacity limitations compared to paid plans.

By subscribing to a paid plan, you agree to pay the applicable fees. Subscription details, including pricing and billing frequency, are displayed at the time of purchase. We reserve the right to change pricing with reasonable notice to existing subscribers.

Label Dashboard

If you use the Label Dashboard to manage artists, you represent that you have the necessary rights, agreements, or authorization to manage those artists’ information on our platform. You are solely responsible for the accuracy of artist data you enter and for maintaining appropriate agreements with any artists you manage through the tool.

THRY.ARCHIVE is not a party to any agreement between you and your artists. We are not liable for disputes between labels and their artists.

Shop & Purchases

Merchandise purchases are processed through Stripe. By making a purchase, you also agree to Stripe's Consumer Terms. All prices are displayed in USD unless otherwise noted.

Merchandise is produced and shipped by third-party print-on-demand partners (Printify and/or Printful). Shipping times, product quality, and fulfillment are subject to their processes. We work to ensure quality but are not directly responsible for manufacturing defects or shipping delays caused by our fulfillment partners.

YouTube Integration

THRY.VISUAL uses the YouTube Data API v3 to upload videos to your YouTube channel. By connecting your YouTube account, you also agree to be bound by YouTube's Terms of Service and acknowledge Google's Privacy Policy.

You can revoke THRY.VISUAL’s access to your YouTube account at any time through the tool’s disconnect feature or via your Google Account permissions.

User Content

You retain all ownership rights to content you upload or create using our tools, including audio files, artwork, press releases, EPKs, and any other materials. THRY.ARCHIVE does not claim ownership over your content.

You represent and warrant that:

• You own or have the necessary rights to all content you upload or create
• Your content does not infringe any third-party intellectual property rights
• Your content complies with all applicable laws and platform guidelines

Blog comments, contact form submissions, and application materials become part of our operational records. We may remove user-generated content (such as blog comments) at our discretion.

THRY.ARCHIVE Branding

Videos generated through THRY.VISUAL include a THRY.ARCHIVE watermark. By using the tool, you agree to the inclusion of this branding in your generated videos.

Prohibited Use

You may not use the Service to:

• Upload or distribute content that is illegal, harmful, threatening, defamatory, or otherwise objectionable
• Infringe on the intellectual property rights of others
• Distribute malware or interfere with the Service’s operation
• Attempt to gain unauthorized access to the Service, other accounts, or our systems
• Use automated tools, bots, or scrapers to access the Service without permission
• Circumvent rate limits, access controls, or other security measures
• Resell, sublicense, or redistribute access to paid tools or features
• Use the Service to spam, phish, or conduct any fraudulent activity
• Misrepresent your identity or affiliation with any person or organization

Intellectual Property

The THRY.ARCHIVE name, logo, website design, tool interfaces, and all original content on thryarchive.com are the property of THRY ARCHIVE LLC and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from our proprietary materials without written permission.

Indemnification

You agree to indemnify, defend, and hold harmless THRY ARCHIVE LLC, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, your content, or your infringement of any third-party rights.

Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We make no warranties regarding the quality, accuracy, or reliability of any content, tools, or results generated through the Service.

Limitation of Liability

To the maximum extent permitted by law, THRY ARCHIVE LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, without limitation, damages for loss of profits, data, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in New York.

Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including Intellectual Property, Indemnification, Disclaimer of Warranties, Limitation of Liability, and Governing Law) will survive.

Changes to Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of the Service after changes constitutes acceptance of the revised terms. For material changes, we will make reasonable efforts to notify active account holders.
